Lush Gardens – Terms & Conditions
These Terms & Conditions govern your use of our website and the purchase of products from Lush Gardens. By accessing our website or placing an order, you agree to comply with and be bound by the terms outlined below.
- Definition
(i) “Buyer” means any business that buys the goods.
(ii) “Consumer” refers to an individual purchasing goods for personal use and not for resale or commercial purposes, where applicable under law.
(iii) “Supplier” refers to our company, Lush Gardens, including its owners, directors, employees, and authorised representatives, providing goods under these Terms & Conditions.
(iv) “Goods” or “Products” refers to all electronic products, home appliances, accessories, and related items supplied by us.
(v) “Contract” means a legally binding agreement formed between the Supplier and the Buyer once an order is accepted and confirmed.
- Conditions
(i) These Terms and Conditions apply to all contracts for the sale of products by the supplier.
(ii)Nothing contained within these Terms & Conditions shall limit or override any statutory rights that a Buyer may have where they qualify as a Consumer under applicable law.
(iii) Acceptance of delivery of the Goods shall constitute full and final acknowledgement that the Buyer agrees to be bound by these Terms & Conditions.
(iv) Any agreed special terms or variations will be confirmed in writing and issued via email, forming an official Schedule to this agreement.
(v) We are not liable for indirect, incidental, or consequential damages resulting from the use or resale of our products.
(v) Any complaints or formal notices must be submitted in writing to the Supplier at the registered trading address specified in Clause 1(5).
- Ordering
(i) All orders placed by the Buyer are treated as an offer to purchase Goods under these Terms & Conditions and remain subject to the Supplier’s acceptance.
(ii) The Supplier reserves the right to decline any order at its discretion.
(iii) If any Goods are unavailable, the Supplier will inform the Buyer. The Buyer may choose a replacement product, wait for restocking, or request a credit note within 28 days.
(iv) Once payment has been completed, the Buyer may request cancellation in writing within 24 hours. All cancellations, regardless of how the order was placed, are subject to a cancellation or restocking fee.
- Intellectual Property
All website content, including logos, text, graphics, and product descriptions, remains our property and may not be copied, reproduced, or distributed without written consent.
- Limitation of Liability
We are not liable for indirect, incidental, or consequential damages resulting from the use or resale of our products.
- Pricing & Payments
(i) Delivery charges apply as specified, which are confirmed after order placement.
(ii) The total price, including VAT and delivery, is confirmed at checkout.
(iii) Full payment, including VAT and delivery charges, must be cleared before dispatch.
(iv) Payments must be made in GBP and may be completed via approved methods such as bank transfer, PayPal, card payment, cheque, banker’s draft, postal order, or cash on collection.
(v) Order confirmation will be sent by email once processed.
- Supplier’s Rights
(i) The Supplier may remove any Goods from the Website at any time without prior notice and without incurring liability.
(ii) The Supplier retains full discretion to decline or cancel any order without obligation or liability.
(iii) Prices are subject to change and are only confirmed at the time of order placement
(iv) While every effort is made to ensure pricing accuracy, the Supplier reserves the right to amend pricing where necessary.
(v) If payment is delayed, incomplete, or uncleared for any reason, the Supplier reserves the right to withhold or suspend dispatch of Goods until full cleared funds are received.
- Changes to Terms
(i) The Supplier reserves the right to update or amend these Terms & Conditions at any time.
(ii) Any such changes will not affect orders already placed or agreements previously accepted by the Buyer.
(iii) Updated terms will be published on this page and will take effect immediately upon posting.
(iv) No amendment or modification to these Terms & Conditions shall be valid unless expressly agreed in writing by the Supplier.
